SUBSTITUTED TRUSTEE’S NOTICE OF SALE
WHEREAS, on September 26, 2008, Stevie D. Love executed a Fixed Rate Home Equity Line of Credit – Land Deed of Trust to B. Sean Akins, as Trustee, for the use and benefit of CB&S Bank Eupora, which Deed of Trust is recorded in Book 238 at Page 15 and corrected by instrument filed for record November 10, 2008 in Book 238 at Page 130, in the land records of the Chancery Clerk of Webster County, Mississippi; and
WHEREAS, CB&S Bank Eupora is one and the same entity as CB&S Bank; and
WHEREAS, default is continuing under the above described Fixed Rate Home Equity Line of Credit – Land Deed of Trust, and the undersigned, CB&S Bank, as current and present owner of said Fixed Rate Home Equity Line of Credit – Land Deed of Trust, has elected to declare the entire indebtedness secured by said Fixed Rate Home Equity Line of Credit – Land Deed of Trust due and payable as provided for therein; and
WHEREAS, said Fixed Rate Home Equity Line of Credit – Land Deed of Trust authorized the appointment and substitution of another Trustee in the place of the Trustee named in said Fixed Rate Home Equity Line of Credit – Land Deed of Trust, and CB&S Bank, pursuant to said Fixed Rate Home Equity Line of Credit – Land Deed of Trust, substituted James P. Wilson, Jr. as Trustee in the place of the original Trustee, by written instrument acknowledged on June 16, 2021, and filed for record in the office of the Chancery Clerk of Webster County, Mississippi, on June 29, 2021, in Book 2021, Page 450 also in said land records; and
WHEREAS, default having been made in the performance of the conditions and stipulations as set out in the above described Fixed Rate Home Equity Line of Credit – Land Deed of Trust and the said Substituted Trustee having been requested and directed by CB&S Bank to execute the trusts; and in strict accordance with the Fixed Rate Home Equity Line of Credit – Land Deed of Trust aforesaid and the Laws of Sale of the State of Mississippi, the dates for publication of this Substitute Trustee’s Notice of Sale in the Webster Progress Times, a newspaper published in the City of Eupora, Webster County, Mississippi, having been set at the following, to wit: July 28, 2021, August 4, 2021, August 11, 2021 and August 18, 2021. Notice is hereby given that I will, on August 19, 2021, during the legal hours, which are between the hours of 11:00 a.m. and 4:00 p.m. at the Main Door of the Webster County Courthouse located in Walthall, Mississippi, offer for sale, at public auction and sell to the highest and best bidder for cash, the following described real property lying and being in Webster County, State of Mississippi, and being more particularly described as follows:
A parcel of land situated in the North Half (N 1/2) of the South Half (S 1/2) of Section 6, Township 20 North, Range 12 East, Webster County, Mississippi, described as: Commencing at the Northwest Corner of the Southeast Quarter (SE 1/4) of Section 6; thence East 60 feet, more or less, to a point in the East ditch line of Old Highway 15 the Point of Beginning for this parcel; thence East 295 feet; thence South 20 degrees 32 minutes West 295 feet; thence West 295 feet to a point in the East ditch line of Old Highway 15; thence North 20 degrees 32 minutes East 295 feet to the Point of Beginning, containing 1.87 acres, more or less, according to survey made by Ralph C. Duke, MS Reg. Land sur. No. LS 1467, dated April 24, 1978. The Grantors herein convey such mineral interest in the aforedescribed land as they own at the time of this conveyance.
Title to the above described property is believed to be good but I will convey only such title as vested in me as Substitute Trustee, without warranty of any kind whatsoever.
