SUBSTITUTE TRUSTEE’S NOTICE OF SALE
WHEREAS, on April 5, 2006, Sonja C. Myers and Aubrey Myers, wife and husband executed a deed of trust for the benefit of Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for Cadence Bank N.A., which deed of trust was recorded on April 7, 2006, in Book 224, Page 41 in the office of the Chancery Clerk of Webster County, Mississippi; and Said Deed of Trust was last sold, assigned and transferred to Nationstar Mortgage LLC d/b/a Mr. Cooper by assignment recorded in Book 262, Page 31 in the office of the Chancery Clerk, Webster County, Mississippi.
WHEREAS, the holder of the deed of trust at the time of the substitution substituted McCalla Raymer Leibert Pierce, LLC as Trustee, as authorized by the terms thereof, by instrument recorded and spread at large upon the records in the office of the aforesaid Chancery Clerk in Book 2020, Page 163, prior to the posting and publication of this notice; and
WHEREAS, default having been made in the terms and conditions of the deed of trust, and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of the deed of trust, and the legal holder of said indebtedness, Nationstar Mortgage LLC d/b/a Mr. Cooper, has requested the undersigned Substitute Trustee to execute the trust and sell said land, property and improvements in accordance with the terms of the deed of trust for the purpose of raising the sums due thereunder, together with attorney's fees, Substitute Trustee’s fees and expenses of sale;
THEREFORE, on July 28, 2021, the undersigned Substitute Trustee in the deed of trust, will offer for sale at public outcry and sell to the highest bidder for cash, within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.) at the East door of the Webster County Courthouse in Walthall, Mississippi, the following described land, property and improvements lying and being situate in Webster County, Mississippi, to-wit:
A parcel of land situated in the Southwest Quarter of the Southeast Quarter of Section 4, Township 20 North, Range 11 East, Webster County, Mississippi, described as: Beginning at the Southwest corner of said Southwest Quarter of the Southeast Quarter; thence North 02 degrees, 28 minutes East along the existing fence line 288.30 feet to a 24 inch oak tree; thence North 85 degrees 14 minutes East along an existing fence line 164.42 feet to a point in the West Right-of-Way of the Mathiston and Clarkson Public Road; thence South 21 degrees, 26 minutes East along said Road Right-of-Way 333.80 -feet; thence North 88 degrees, 16 minutes West 298.40.feet to the POINT OF BEGINNING, containing 1.59 acres.
I WILL CONVEY only such title as is vested in the Substitute Trustee.
