WHEREAS, on July 18, 2007, Bakari Neal, an unmarried person executed a deed of trust for the benefit of Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for SunTrust Mortgage Inc., its successors and assigns, which deed of trust was recorded on July 25, 2007, in Book 618, Page 377 in the office of the Chancery Clerk of Winston County, Mississippi; and
WHEREAS, the aforementioned deed of trust was assigned by Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for SunTrust Mortgage Inc., its successors and assigns to Litton Loan Servicing, LP, by instrument dated September 19, 2008, and recorded on October 2, 2008, in Book 630, Page 475 of the records of the aforesaid Chancery Clerk; and
WHEREAS, the aforementioned deed of trust was assigned by Litton Loan Servicing, LP to Green Tree Servicing, LLC, by instrument dated March 27, 2014, and recorded on April 4, 2014, in Book 682, Page 774 of the records of the aforesaid Chancery Clerk; and
WHEREAS, Ditech Financial LLC, the holder of the deed of trust, substituted McCalla Raymer Leibert Pierce, LLC as Trustee, as authorized by the terms thereof, by instrument recorded on August 5, 2019, and spread at large upon the records in the office of the aforesaid Chancery Clerk in Book 4, Page 589, prior to the posting and publication of this notice; and
WHEREAS, default having been made in the terms and conditions of the deed of trust, and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of the deed of trust, and the legal holder of said indebtedness, Ditech Financial LLC, has requested the undersigned Substitute Trustee to execute the trust and sell said land, property and improvements in accordance with the terms of the deed of trust for the purpose of raising the sums due thereunder, together with attorney’s fees, Substitute Trustee’s fees and expenses of sale;
THEREFORE, on October 2, 2019, the undersigned Substitute Trustee in the deed of trust, will offer for sale at public outcry and sell to the highest bidder for cash, within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.) at the North door of the Winston County Courthouse in Louisville, Mississippi, the following described land, property and improvements lying and being situate in Winston County, Mississippi, to-wit:
Begin at the Southeast corner of the NW ¼ of NE ¼ of Section 21, Township 14 North, Range 14 East, and run South 87 degrees 30 minutes West for 743.0 feet to a point on the North side of a gravel road, and the point of beginning of the plot herein described; from the above described point of beginning, run thence South 89 degrees 32 minutes West along said road for 210 feet to the intersection of a road running North and South; run thence North 0 degrees 31 minutes East along the East side of said road for 210 feet, thence North 89 degrees 32 minutes East for 210 feet; thence South 0 degrees 31 minutes West for 210 feet to the point of beginning; describing 1 acres more or less, in the West ½ of NE ¼ of Section 31, Township 14 North, Range 14 East, Winston County, Mississippi, all as is more in detail shown on plat attached to Deed recorded in Deed Book 122 Page 143, reference to which is hereby made.

WHEREAS on or about the 23rd day of January, 2015, a judgment in the amount of $102,951.80, plus post judgment interest at 7.58% from April 6, 2015, was entered against Cedell Murff and the Cedell Murff Revocable Trust in favor of PNC Bank, NA, said Judgment later assigned to SMS Financial P, LLC, in that certain case presently filed in the Circuit Court of Wayne County, Michigan, and being more particularly styled, PNC Bank, NA (SMS Financial P, LLC, Assignee) v. WHEREAS after statutory interest and taxable costs, the present outstanding balance on said judgment as of October 28, 2019 is $138,571.09;
WHEREAS the Judgment Debtor, Cedell Murff and the Cedell Murff Revocable Trust, is the owner of certain real property located in Winston County, Mississippi, more particularly described herein below;
WHEREAS a writ of execution has issued from the Circuit Court Clerk of Winston County, Mississippi, directing the Sheriff of Winston County to levy upon, seize and execute upon said real property and to sell same all in accordance with the provisions of Mississippi Code Annotated Section 13-3-123, 13-3-161, 13-3-163, 13-3-169, 13-3-187 and 11-7-7 (1972), and to sell same in accordance with the provisions of Mississippi Code Annotated Section 13-3-163 (1972);
WHEREAS the Sheriff of Winston County, Mississippi, (acting through one or more duly authorized deputies), did levy upon said realty by service of the writ and going to the land of the defendant, and there declared that he attached the same at the suit of the plaintiff, and attaching and levying upon the same by returning that he has attached and levied upon the land, and filing said return in the aforereferenced court records; and
