SUBSTITUTED TRUSTEE’S NOTICE OF SALE
WHEREAS, on October 9, 2015, Justin Matthew Sims and Brittney S. Sims, husband and wife executed a certain deed of trust to Burchfield Law Firm, PLLC, Trustee for the benefit of Mortgage Electronic Registration Systems, Inc. as nominee for American Southwest Mortgage Corp., its successors and assigns which deed of trust is of record in the office of the Chancery Clerk of Webster County, State of Mississippi in Book 2015 at Page 577; and
WHEREAS, J.P. Morgan Mortgage Acquisition Corp. has heretofore substituted Shapiro & Brown, LLC as Trustee by instrument dated November 8, 2019 and recorded in the aforesaid Chancery Clerk’s Office in Book 2019 at Page 619; and
WHEREAS, default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said deed of trust, J.P. Morgan Mortgage Acquisition Corp., the legal holder of said indebtedness, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust and for the purpose of raising the sums due thereunder, together with attorney’s fees, trustee’s fees and expense of sale.
NOW, THEREFORE, I, Shapiro & Brown, LLC, Substituted Trustee in said deed of trust, will on December 18, 2019 offer for sale at public outcry and sell within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.), at the East Door of the County Courthouse of Webster County, located at 6333 Highway 9, Suite 123, Walthall, MS 39771, to the highest and best bidder for cash or certified funds the following described property situated in Webster County, State of Mississippi, to-wit:
1.0 acres, more or less, located West of the Walthall-Mantee Public Road in the N1/2 of the NW 1/4 of Section 15, Township 21 North, Range 11 East, Webster County, MS described as:
Beginning at the intersection of the South boundary line of the said N 1/2 of the said NW 1/4 of said Section 15 and the Western boundary line of the Walthall-Mantee Public Blacktop Road right-of-way as a POINT OF REFERENCE and running North 33 feet along the said West right-of-way to a fence corner which is the POINT OF BEGINNING for the lot herein described:
Thence around said 1.0 acres, more or less, as follows: North along the West right-of-way of said Walthall-Mantee Public Blacktop Road 105 feet; thence West 415 feet; thence South 105 feet parallel to said West right-of-way thence East 415 feet, more or less to the POINT OF BEGINNING.
I WILL CONVEY only such title as vested in me as Substituted Trustee.
