WHEREAS, on September 29, 2003, Miranda R. Welch, a single
person, executed a certain deed of trust to Kenneth C. Randle,
as Trustee and the United States of America acting through the
Rural Housing Service or successor agency, United States
Department of Agriculture, as Beneficiary, which deed of trust is
of record in the Office of the Chancery Clerk of Winston County,
State of Mississippi, in Book 574, Page 330 and re-recorded in
Book 584, Page 285;
WHEREAS, default has occurred in the payment of the indebtedness
secured by said deed(s) of trust, and The United States
of America, acting by and through the United States Department
of Agriculture, as Beneficiary, has authorized and instructed
Stephens Millirons, P.C. as Substitute Trustee to foreclose said
deed(s) of trust by advertisement and sale at public auction in
accordance with the statutes made and provided therefor.
THEREFORE, notice is hereby given that pursuant to the power
of sale contained in said deed(s) of trust and in accordance with
the statutes made and provided therefor, the said deed(s) of
trust will be foreclosed and the property covered thereby and
hereinafter described will be sold at public auction to the highest
bidder for cash at the Winston County Courthouse at Louisville,
Mississippi, in the aforesaid County and will sell within legal
hours (being between the hours of 11:00 AM and 4:00 PM) on
January 29, 2020, to satisfy the indebtedness now due under
and secured by said deed(s) of trust.
Stephens Millirons, P.C. will convey only such title as vested in it
as Substituted Trustee.
The premises to be sold are described as:
Commencing at the Southwest corner of the Northwest Quarter
of Section 24, Township 15 North, Range 11 East, Winston
County, Mississippi, said point being occupied by an iron “T”
post, proceed East 1272.00 feet; thence North 1327.17 feet to a
half inch diameter iron rebar on the North right-of-way boundary
of Major Brown Road (60 feet total right-of-way width) and the
POINT OF BEGINNING of this parcel herein described.
From described POINT OF BEGINNING, proceed North 00
degrees 00 minutes East 409.83 feet to a half inch diameter iron
rebar; thence North 90 degrees 00 minutes East 201.92 feet to
a half inch diameter iron rebar; thence South 00 degrees 00 minutes
West 420.47 feet to a half inch diameter iron rebar on the
North right-of-way boundary of Major Brown Road (60 feet total
right-of-way width); thence along said North right-of-way boundary
North 88 degrees 43 minutes West 167.88 feet to a point;
thence continuing along said North right-of-way boundary North
78 degrees 35 minutes West 34.78 feet to the POINT OF
BEGINNING.
Said parcel contains 1.94 acres and is located in the Northeast
Quarter of the Northeast Quarter and in the Northwest Quarter
of the Northeast Quarter of Section 24, Township 15 North,
Range 11 East, Winston County, Mississippi.
This property will be sold on an “as is, where is” basis, subject
to any easements, encumbrances, and exceptions reflected in
the deed of trust and those contained in the public records of
County where the above-described property is situated. This
property will be sold without warranty or recourse, expressed or
implied as to condition, title, use and/or enjoyment.
The successful bidder must tender a non-refundable deposit of
Five Thousand Dollars ($5,000.00) in certified funds made
payable to Stephens Millirons, P.C. at the time and place of sale.
The balance of the purchase price must be paid in certified funds
by noon on the second business day following the sale at the law
firm of Stephens Millirons, P.C. at 120 Seven Cedars Drive,
Huntsville, Alabama 35802.
