WHEREAS, on February 26, 2016, YOAN HERNANDEZ and YUNEISY HERNANDEZ, executed a Deed of Trust to Robert Thomas, Trustee, to secure a Home Equity Line of Credit Agreement and Disclosure in the principal amount of NINETY FIVE THOUSAND AND NO/100 DOLLARS ($95,000.00), same being payable in monthly installments over a period of one hundred twenty (120) equal installments of principal and interest at 0.633% percent beginning on February 26, 2016, and continuing until March 20, 2026; until paid in full as set out in the Deed of Trust aforesaid, which is of record in Trust Book 207, Page 671 in the Chancery Clerk’s Office of Choctaw County, Mississippi, and
WHEREAS, on the 14th day of November, 2019, THE CITIZENS BANK OF PHILADELPHIA, did execute a Substitution of Trustee, naming ZACHARY A. MADISON as Substituted Trustee, which substitution is recorded in Book 226, Page 224, in the Office of the Chancery Clerk of Choctaw County, Mississippi; and
WHEREAS, default has been made in the payment of the indebtedness secured by said Deed of Trust, and THE CITIZENS BANK OF PHILADELPHIA, being the owner and holder of said Deed of Trust, having requested the undersigned so to do, I will on the 8th day of January, 2020, offer for sale and will sell within legal hours (between the hours of 11:00 a.m. and 4:00 p.m.) at the front door of the Courthouse in Ackerman, Choctaw County, Mississippi, to the highest bidder in cash, at public outcry, the following described property located and being situated in the County of Choctaw, State of Mississippi, to-wit:

WHEREAS, by various assignments on record said Deed of Trust was ultimately assigned to Bayview Loan Servicing, LLC, a Delaware Limited Liability Company by instrument recorded in the office of the aforesaid Chancery Clerk in Land Mortgage Book 211 at Page 447 ; and
WHEREAS, on the 11th day of April, 2019 the Holder of said Deed of Trust substituted and appointed Dean Morris, LLC as Substitute Trustee by instrument recorded in the office of the aforesaid Chancery Clerk in Land Deed Book 223 at Page 793; and
WHEREAS on the 23rd day of October, 2019, by Order granting Default Judgment and Final Judgment on the Pleadings, in the matter of Bayview Loan Servicing, LLC, a Delaware Limited Liability Company vs. The Unknown Heirs at Law of Ester Bernice Liddell, et al., Cause No. 2019-0046 of the Chancery Court of Choctaw County, Mississippi, rendered on the 23rd day of October, 2019, which reforms and revives Deed of Trust in Land Mortgage Book 179 at Page 720 filed in the land records in Choctaw County, Mississippi to be a valid, perfected and enforceable First Priority Lien on the subject property. Said Order appearing in the Chancery Clerk of Choctaw County, Mississippi's land records in Land Deed Book 225 at Page 726 on October 28, 2019; and; and

Public meeting on Tom Glasgow Municipal Park
The Town of Ackerman is proposing to change the location of the Tom Glasgow Municipal Park, a Land and Water Conservation Fund (LWCF) Grant, to another location at Highway 12 and College Street. The new park will include ballfields and related amenities. The Town of Ackerman Mayor and Board of Aldermen are seeking the general public’s input until 5:00 p.m. on February 4, 2020.
