SUBSTITUTED TRUSTEE'S NOTICE OF SALE
WHEREAS, on September 25, 2017, Cedric L. Wooten, single man executed a certain deed of trust to Carrington Title Services, LLC - Ramquest, Trustee for the benefit of Mortgage Electronic Registration Systems, Inc. as beneficiary, as nominee for Carrington Mortgage Services, LLC which deed of trust is of record in the office of the Chancery Clerk of Winston County, State of Mississippi in Book 722 at Page 322; and
WHEREAS, LLG MS LLC has heretofore been substituted as Trustee by instrument dated September 12, 2022 and recorded in the aforesaid Chancery Clerk's Office in Book 765 at Page 720; and
WHEREAS, default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said deed of trust, CARRINGTON MORTGAGE SERVICES, LLC, the legal holder of said indebtedness, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust and for the purpose of raising the sums due thereunder, together with attorney's fees, trustee's fees and expense of sale.
NOW, THEREFORE, I, LLG MS LLC, Substituted Trustee in said deed of trust, will on November 23, 2022 offer for sale at public outcry and sell within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.), at the North Door of the County Courthouse of Winston County, located at 115 West Main Street, Louisville, MS 39339, to the highest and best bidder for cash or certified funds the following described property situated in Winston County, State of Mississippi, to-wit:

Sealed bids for the Safe Room Community Connector Sidewalk Project, Federal-Aid Project No. STP-0300-00(003) LPA/108862-70100, will be received no later than 10:00 A.M. Local Time, Wednesday, December 14th , 2022, in the office of the city clerk, located at 2373 South Church Avenue, Louisville, Mississippi 39339 or electronically via www.neel-schafferplans.com. All bids received will be publicly opened and read aloud.
The work shall consist essentially of construction of concrete sidewalk, curb and gutter, ADA ramps, asphalt milling and overlay, striping, and signage.
The above general outline of features of the work does not in any way limit the responsibility of the Contractor to perform all work and furnish all plant, labor, equipment and materials required by the specifications and the drawings referred to therein.
The attention of bidders is directed to the Contract Provisions governing selection and employment of labor. Minimum wage rates for Federal – Aid projects have been predetermined by the Secretary of labor and are subject to Public Law 87-581 Work hours Act of 1962, set forth in the Contract Provisions.
The City of Louisville hereby notifies all Bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, disadvantaged and women’s business enterprises will be afforded the full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award.
The award of this contract will be contingent upon the Contractor satisfying the DBE/WBE requirements. The DBE goal for this project is 1 percent.
The contract Documents are being made available electronically and via paper copy (if requested). Plan holders are required to register for an account at www.neel-schafferplans.com to view and order Bid Documents. All plan holders are required to have a valid email address for registration. Bid documents are non-refundable and must be purchased through the website. The proposal and contract documents in its entirety shall be submitted electronically or in a sealed envelope to the office of the city clerk, located at 2373 South Church Avenue, Louisville, Mississippi 39339 prior to the hour and date above designated. No stripped bids will be accepted.
Each bid shall be accompanied by a Cashier’s check, Certified Check on a solvent bank or a Bidder’s Bond issued by a surety Company licensed to operate in the State of Mississippi, in the amount of five percent (5%) of the total bid price, payable to the City of Louisville as bid security. Bidders shall also submit a current financial statement, if requested by the Owner. The successful bidder will be required to furnish a Performance Bond and a Payment Bond in the amount of one hundred percent (100%) of the contract amount.
No bidder may withdraw his bid within (60) days after the date of actual bid opening, without Owner’s consent.
Work to be performed shall be in accordance with the Mississippi Road and Bridge Construction (the 2017 edition) together with all amendments and / or special provisions and/or addenda to the standards duly approved and adopted, unless otherwise noted in these specifications. The 2017 Edition of the Mississippi Standard Specifications for Road and Bridge Construction, adopted by the Mississippi Department of Transportation, as referred to herein, may be purchased from the Mississippi Department of Transportation.
