SUBSTITUTED TRUSTEE’S NOTICE OF SALE

COUNTY OF Winston
WHEREAS, on the 24th day of February, 2006, Elsie Goss Kelly Hayes a single person, executed and delivered a certain Deed of Trust unto Debera Bridges, Trustee for Citifinancial Real Estate Services, Inc., Beneficiary, to secure an indebtedness therein described, which Deed of Trust is recorded in the office of the Chancery Clerk of Winston County, Mississippi in Deed of Trust Book 601 at Page 178; and
WHEREAS, by various assignments on record said Deed of Trust was ultimately assigned to Bayview Loan Servicing, LLC, a Delaware Limited Liability Company by instrument recorded in the office of the aforesaid Chancery Clerk in Deed of Trust Book 716 at Page 103; and
WHEREAS, on the 7th day of December, 2018 the Holder of said Deed of Trust substituted and appointed Dean Morris, LLC as Substitute Trustee by instrument recorded in the office of the aforesaid Chancery Clerk in Gen Subst of Trustee Book 4 at Page 526; and
WHEREAS, the subject deed of trust was reformed by Judgment rendered in the matter styled Bayview Loan Servicing, LLC vs Elise Hayes, et al; Civil Action No. 19-81 of the Chancery Court of Winston County, Mississippi, rendered on the 5th day of March, 2020, said judgment reforming the Legal description of that certain Deed of Trust at Deed of Trust Book 601 Page 178 in Winston County Chancery Clerk's land records. Judgment also declared subject Deed of Trust as a perfected, first priority and enforceable lien. Said judgment appearing in the Winston County Chancery Clerk's land records in Deed Book 383 Page 246 on March 9, 2020; and
WHEREAS, default having been made in the payments of the indebtedness secured by the said Deed of Trust, and the holder of said Deed of Trust, having requested the undersigned so to do, on the 13th day of May, 2020, I will during the lawful hours of between 11:00 a.m. and 4:00 p.m., at public outcry, offer for sale and will sell, at the north front door of the Winston County Courthouse at Louisville, Mississippi, for cash to the highest bidder, the following described land and property situated in Winston County, Mississippi, to-wit:
The following described property located in the County of Winston, State of Mississippi, to-wit: Beginning at a Point 1363 feet East and 640 feet South of the NW corner of the SW 1/4 of the SW 1/4 of Section 13, Township 15 North, Range 11 East, run thence South 275 feet; thence West 302 feet; thence North 275 feet; thence East 302 feet to the Point of Beginning; being 1.9 acres more or less in the E 1/2 of the SW 1/4 of the SW 1/4 of Section 13, Township 15 North, Range 11 East.
Being the same property conveyed by Fee Simple Deed from Howard Goss and Mattie Laura Goss to Elsie Goss Kelly Hayes, Dated 04/27/1982 recorded on 04/27/1982 in Book 153, Page 203 in Winston County Records, State of MS.
I will only convey such title as is vested in me as Substitute Trustee.

Letters of Administration having been granted on the 26th day of November, 2019, by the Chancery Court of Winston County, Mississippi, to the undersigned in the Estate of James Erwin Nabers, Deceased, notice is hereby given to all persons having claims against the Estate of James Erwin Nabers, Deceased, to present the same to the Clerk of this Court for probate and registration according to the law within ninety (90) days from the first publication of this Notice or they will be forever barred.
