WHEREAS, WILMINGTON SAVINGS FUND SOCIETY, FSB, AS TRUSTEE OF QUERCUS MORTGAGE INVESTMENT TRUST has heretofore substituted Shapiro & Brown, LLC as Trustee by instrument dated November 4, 2015 and recorded in the aforesaid Chancery Clerk's Office in Book 701 at Page 589; and

The Board of Supervisors (the AGoverning Authority@) of Winston County, Mississippi (the "County"), took up for consideration the matter of considering the expansion of the previously incorporated Betheden Fire Protection Grading District. After a discussion of the subject, Supervisor Marion Jordan offered and moved the adoption of the following resolution:
RESOLUTION EXPANDING THE
BETHEDEN FIRE PROTECTION GRADING DISTRICT
PURSUANT TO
MISSISSIPPI CODE ANNOTATED '19-5-215 ET SEQ
WHEREAS, a petition for the expansion of the Betheden Fire Protection Grading District (the ADistrict@), was filed with the Governing Authority on December 30, 2019, and considered by the Governing Authority at its meeting on January 6, 2020, all pursuant to Mississippi Code Annotated '19-5-215 et seq (the ACode@); and
WHEREAS, the petition, as filed, was determined by the Governing Authority to include all the necessary information, and signatures by owners of real property residing with the proposed boundaries of the District, as required by the Code; and
WHEREAS, the Governing Authority, declared its intention to expand the previously incorporated Betheden Fire Protection Grading District, set and advertised for a public hearing for the purpose of determining whether or not public convenience and necessity requires the expansion of the district; and notice of such public hearing was published in a newspaper of local publication once a week for at least three (3) consecutive weeks prior to the date of such hearing, in accordance with §19-5-221 of the Mississippi Code of 1972; and
WHEREAS, the Governing Authority held a public hearing on the issue of whether or not public convenience and necessity requires the expansion of the District; received public comment; reviewed all information before it; fully discussed the matter and determined the expansion of the Betheden Fire Protection Grading District is fully supported by public convenience and necessity; and
WHEREAS, the Governing Authority fixed a public hearing to determine whether or not the qualified electors of the proposed District wish to protest the creation of the District and notice of such public hearing was published in a newspaper of local publication once a week for at least three (3) consecutive weeks prior to the date of such hearing, in accordance with §19-5-221 of the Mississippi Code of 1972 with a copy of the Proof of Publication for such hearing being attached to this Resolution as Exhibit B; and
WHEREAS, no written protest was filed with the Governing Authority by the qualified electors of the proposed expanded District, as required by Miss. Code Ann. ' 19-5-221; and having received public comment and fully discussed the matter, the Governing Authority determined the formation of the District should be approved.
NOW, THEREFORE, BE IT RESOLVED, as follows:
Section 1. The previously incorporated Betheden Fire Protection Grading District is hereby expanded pursuant to the §19-5-221 of the Mississippi Code. As provided by Mississippi Code Annotated §19-5-227, the expansion of the District shall be final and conclusive and shall not thereafter be subject to attack in any court fifteen (15) days from and after the date of the adoption of this resolution, provided no appeal be taken by any party having an interest in the subject matter and aggrieved or prejudiced by the findings and adjudication of the Governing Authority.
Section 2. The Governing Authority shall act on behalf of the expanded District and may exercise any of the powers granted the District under the provisions of Mississippi Code Annotated Sections 19-5-215 through 19-5-241. The Governing Authority shall record any such actions in its minutes, conducting such business during any public meeting of the body.
Section 3. The District shall be known as the Betheden Fire Protection Grading District.
Section 4. The boundaries of the expanded District are set forth in Exhibit A attached hereto and incorporated herein by reference.
