Letters Testamentary having been granted to the undersigned by the Chancery Court of Webster County, Mississippi, on the Estate of Irby Neal Mitchell, Deceased, on the 2nd day of March, 2020, notice is hereby given to all persons having claims against the said Estate to have their claims probated and registered by the Clerk of the Chancery Court of Webster County, Mississippi, within ninety (90) days from the first publication of this notice, and that failure to probate and register their claims with the Clerk within that time will forever bar the claim.

REQUEST FOR QUALIFICATIONS FOR ENGINEERING SERVICES
The Town of Mathiston requests proposals from qualified firms or individuals to provide engineering services for work related to the implementation of approved FY2020 CDBG project(s) related to wastewater improvements. You are invited to submit a proposal, in accordance with this request, to the Office of the Town Clerk, 41 Mathis Drive, P. O. Box 178, Mathiston, Mississippi 39752 no later than 2:00 p.m. on April 6, 2020.
The Engineer will be responsible for preparing project cost estimates for application preparation and if awarded, the selected Engineer will provide all engineering services through project closeout in accordance with federal, state and local laws, regulations and policies. The scope of work includes, but is not limited to, the following: 1.) prepare plans and specifications; 2.) distribute bid documents; 3.) assist in bid opening and prepare bid tabulation; 4.) assist in the execution of construction contracts; 5.) hold pre-construction conference; and 6.) perform construction inspection including periodic reports to the Town and approve all payment requests.
The Town of Mathiston is an Equal Opportunity Employer. The Town encourages Minority-owned Business Enterprises (MBEs) and Woman-owned Business Enterprises (WBEs) to submit proposals. The Town also encourages Section 3 eligible businesses to submit proposals. Section 3 of the Housing and Urban Development Act of 1968, as amended (12 U.S.C. 17010) requires, to the greatest extent feasible, that the Town and its contractors that participate in the above referenced Program, give opportunities for job training and employment to lower income residents of Mathiston. Section 3 also requires that contracts for work in connection with the Section 3 area be awarded to Section 3 eligible business concerns.
All proposals must be submitted in a sealed envelope and marked with the following language; “Proposal for CDBG Engineering Services,” Proposals will be evaluated on the following factors: Qualifications (40 points), Experience (40 points) and Capacity for Performance (20 points). To be evaluated properly, the following must be addressed in detail:
Qualifications - List of qualifications of persons to be assigned to project;
Experience – Information regarding the firm’s experience and the projects previously undertaken, including the type and amount of grants awarded, the projects activities, and the status of the projects;
Capacity for Performance – Identify the number and title of staff assigned to provide services.
The Town will designate a selection committee to evaluate each proposal. The selection committee may hold proposals for a period of not to exceed thirty (30) days for the purpose of reviewing the content of the proposals and investigating the qualifications of the firms and assigned individuals. The town reserves the right to reject and/or all proposals.
Subject to CDBG award(s) and the removal of all environmental conditions, the Town will award a contract with the qualified individual or firm whose proposal has the highest number of cumulative points issued by the selection committee and determined to be the most advantageous to the Town, price and other factors considered. The contract will include scope and extent of work and other essential requirements. An individual contract will be executed for each awarded project, and the contract will be on a fixed price basis. The Town has the authority to terminate the selection at any time.

SUBSTITUTED TRUSTEE’S NOTICE OF SALE
WHEREAS, on November 6, 2007, Joseph Nicholas Fiebig, an unmarried man executed a certain deed of trust to H. Russell Rogers, Trustee for the benefit of Mortgage Electronic Registration Systems, Inc. as nominee for Cadence Bank, N.A., its successors and assigns which deed of trust is of record in the office of the Chancery Clerk of Webster County, State of Mississippi in Book 233 at Page 96; and
WHEREAS, J.P. Morgan Mortgage Acquisition Corp. has heretofore substituted Shapiro & Brown, LLC as Trustee by instrument dated January 8, 2019; and
WHEREAS, default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said deed of trust, J.P. Morgan Mortgage Acquisition Corp., the legal holder of said indebtedness, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust and for the purpose of raising the sums due thereunder, together with attorney’s fees, trustee’s fees and expense of sale.
NOW, THEREFORE, I, Shapiro & Brown, LLC, Substituted Trustee in said deed of trust, will on April 20, 2020 offer for sale at public outcry and sell within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.), at the East Door of the County Courthouse of Webster County, located at 6333 Highway 9, Suite 123, Walthall, MS 39771, to the highest and best bidder for cash or certified funds the following described property situated in Webster County, State of Mississippi, to-wit:
Beginning at a point 209 feet North from the Southeast corner of Section 27, Township 20, Range 11 East. From said POINT OF BEGINNING run North along the Section line and along the West side of the county road for a distance of 100 feet; thence 90 degrees to the left, parallel to the East line of said Section a distance of 177 feet; thence turn left 90 degrees for a distance of 100 feet; thence turn left 90 degrees for a distance of 177 feet to the POINT OF BEGINNING. Being the same property conveyed to Joe R. Peach, Sr. and wife Jacquelyn M. Peach form Minnie Mae Goodson, et al, dated June 13, 1980, and recorded in Book 87, at Page 233, in the Office of the Chancery Clerk of Webster County, Mississippi, reference to which is here made for further description.
I WILL CONVEY only such title as vested in me as Substituted Trustee.
