WHEREAS, Harry C. Dixon executed a certain Deed of Trust to Steve Taylor as Trustee for the use and benefit of Bankfirst Financial Services, dated August 3, 2020 for the principal amount of $55,246.57, filed for record in the Land Records located in the Office of the Chancery Clerk of Winston County, Mississippi on August 24, 2020, and recorded in said office in Book 747 at Page 45, and re-recorded on April 27, 2021, in said office in Book 753 at Page 176; and
WHEREAS, said default is continuing, the undersigned, Bankfirst Financial Services, as current and present owner of said Deed of Trust, has elected to declare the entire indebtedness secured by said Deed of Trust due and payable as provided for therein; and
WHEREAS, said Deed of Trust authorized the appointment and substitution of another Trustee in the place of the Trustee named in said Deed of Trust, and Bankfirst Financial Services, pursuant to said Deed of Trust, substituted James P. Wilson, Jr. as Trustee in the place of the original Trustee, by written instrument dated April 28, 2021 and filed for record in the office of the Chancery Clerk of Winston County, Mississippi, on May 11, 2021 and recorded in said office in Book 5 at Page 13; and
WHEREAS, default having been made in the performance of the conditions and stipulations as set out in the above described Deed of Trust and the said Substituted Trustee having been requested and directed by Bankfirst Financial Services to execute the trust; and in strict accordance with the Deed of Trust aforesaid and the Laws of Sale of the State of Mississippi, the dates for publication of this Substitute Trustee’s Notice of Sale in the Winston County Journal, a newspaper published in the City of Louisville, Winston County, Mississippi, having been set at the following, to wit: October 6, 2021, October 13, 2021, October 20, 2021, and October 27, 2021. Notice is hereby given that I will, on October 28, 2021, during the legal hours, which are between the hours of 11:00 a.m. and 4:00 p.m. at the north front door of the Winston County Courthouse in the City of Louisville, Mississippi, offer for sale, at public auction and sell to the highest and best bidder for cash, the following described real property lying and being in Winston County, State of Mississippi, and being more particularly described as follows:
Lot 82, Part III of the Northwood Subdivision according to the plat on said subdivision on file in the Chancery Clerk’s office of Winston County, Mississippi, and being in the SE ¼ of the NE ¼ of Section 20, Township 15 North, Range 12 East, LESS twenty (20) feet off the entire South side of Lot 82 of the Northwood Subdivision, Part III.
Indexing instructions to the Winston County Chancery Clerk: Part of Lot 82, Part III of the Northwood Subdivision of the City of Louisville.
Title to the above described property is believed to be good but I will convey only such title as vested in me as Substitute Trustee, without warranty of any kind whatsoever.
