WHEREAS, on May 24, 2006, Jimmy McLemore, single and Rebecca Vaught, single executed a deed of trust for the benefit of Jim Walter Homes, Inc., which deed of trust was recorded on June 19, 2006, in Book 225, Page 26 in the office of the Chancery Clerk of Webster County, Mississippi; and Said Deed of Trust was last sold, assigned and transferred to The Bank of New York Mellon, as Indenture Trustee, for Mid-State Capital Corporation 2006-1 Trust by assignment recorded in Book 2022, Page 229 in the office of the Chancery Clerk, Webster County, Mississippi.
WHEREAS, the holder of the deed of trust at the time of the substitution substituted McCalla Raymer Leibert Pierce, LLC as Trustee, as authorized by the terms thereof, by instrument recorded on February 15, 2023, and spread at large upon the records in the office of the aforesaid Chancery Clerk in Book 2023, Page 67, prior to the posting and publication of this notice; and
WHEREAS, default having been made in the terms and conditions of the deed of trust, and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of the deed of trust, and the legal holder of said indebtedness, The Bank of New York Mellon, as Indenture Trustee, for Mid-State Capital Corporation 2006-1 Trust, has requested the undersigned Substitute Trustee to execute the trust and sell said land, property and improvements in accordance with the terms of the deed of trust for the purpose of raising the sums due thereunder, together with attorney's fees, Substitute Trustee’s fees and expenses of sale;
THEREFORE, on April 14, 2023, the undersigned Substitute Trustee in the deed of trust, will offer for sale at public outcry and sell to the highest bidder for cash, within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.) at the East door of the Webster County Courthouse in Walthall, Mississippi, the following described land, property and improvements lying and being situate in Webster County, Mississippi, to-wit:
Lot No. 1 of Block 4 according to the Magnolia Heights Subdivision-Part 1, according to a Survey thereof as made by Barth and Associates, Inc., Engineers, as same is duly on file in the office of the Chancery Clerk of Webster County, State of Mississippi, subject, however, to certain restrictive covenants contained in instrument executed by said Eupora Developers, Inc., dated October 13, 1965 as same are duly on record in Land Deed Book 60, at page 135 et seq. of the records in the office of the Chancery Clerk of Webster County, Mississippi.
I WILL CONVEY only such title as is vested in the Substitute Trustee.

SUBSTITUTED TRUSTEE’S NOTICE OF SALE
WHEREAS, on November 19, 2001, Mike T. Davis executed a Deed of Trust to Robert McKinney, as Trustee, for the use and benefit of AmSouth Bank, which Deed of Trust is recorded in Book 194 at Page 158 in the land records of the Chancery Clerk of Webster County, Mississippi; and
WHEREAS, on April 8, 2003, Mike T. Davis executed a Modification of Deed of Trust for the use and benefit of AmSouth Bank, which Modification of Deed of Trust is recorded in Book 204 at Page 159 in the land records of the Chancery Clerk of Webster County, Mississippi, said Modification of Deed of Trust modifying the Deed of Trust recorded in Book 194 at Page 158, in said land records, for the purpose of increasing the credit limit described therein; and
WHEREAS, on January 26, 2007, Regions Bank, an Alabama banking corporation and successor by merger to AmSouth Bank, did assign said Deed of Trust to Citizens Bank and Savings Company by instrument recorded in Book 232 at Page 3 and re-recorded in Book 240 at Page 155 in the land records of the Chancery Clerk of Webster County, Mississippi; and
WHEREAS, Citizens Bank and Savings Company is one and the same entity as CB&S Bank; and
WHEREAS, default is continuing under the above described Deed of Trust, and the undersigned, CB&S Bank, as current and present owner of said Deed of Trust, has elected to declare the entire indebtedness secured by said Deed of Trust due and payable as provided for therein; and
WHEREAS, said Deed of Trust authorized the appointment and substitution of another Trustee in the place of the Trustee named in said Deed of Trust, and CB&S Bank, pursuant to said Deed of Trust, substituted James P.
