SUBSTITUTED TRUSTEE’S NOTICE OF SALE
WHEREAS, on March 30, 2017, Douglas A. Cunningham aka Douglas Arthur Cunningham and Thomas E. Newman aka Thomas Edward Newman executed a Deed of Trust to Charles J. Pignuolo, Trustee for the benefit of BancorpSouth Bank, now Cadence Bank, which is recorded in Book 2017 at Page 200 in the office of the Chancery Clerk of Webster County, Mississippi; and
WHEREAS, Underwood Law Firm PLLC has been substituted as Trustee under the Deed of Trust; and
WHEREAS, default has been made in the terms and conditions of the Deed of Trust and the entire debt secured thereby has been declared due and payable in accordance with the terms of the Deed of Trust, and the legal holder of the indebtedness secured thereby, BancorpSouth Bank, now Cadence Bank, has requested the undersigned Substituted Trustee to execute the trust and sell the property in accordance with the terms of the Deed of Trust for the purpose of raising the sums due thereunder together with attorney’s fees, Substituted Trustee’s fees, and expenses of sale.
NOW, THEREFORE, Underwood Law Firm PLLC, as Substituted Trustee under the Deed of Trust, will on March 8, 2024, offer for sale at public outcry to the highest bidder for cash within legal hours (between 11:00 a.m. and 4:00 p.m.) at the east door of the Webster County Courthouse in Walthall, Mississippi, the following described property together with all improvements thereon situated in Webster County, Mississippi:
A parcel of land in Lots 5, 6, and 7 of Block 24 of the Adams Survey of the City of Eupora, Mississippi, more particularly described as follows, to-wit:
Beginning at a found axle shaft that marks the Northeast corner of Lot 5 of Block 24 of said Adams Survey; thence South 01 degree 47 minutes 40 seconds West along the West Right-of-Way of Allen Street go 304.58 feet to a found iron pipe; thence North 89 degrees 41 minutes 21 seconds West 177.19 feet to a found iron pipe; thence North 01 degree 36 minutes 54 seconds East and following a cyclone fence of 307.96 feet to a point in a ditch at the South Right-of-Way of Fox Avenue; thence-along the South Right-of-Way of said Fox Avenue go South 88 degrees 35 minutes 30 seconds East 178.10 feet to the POINT OF BEGINNING.
UNDERWOOD LAW FIRM PLLC will convey only such title as is vested in it as Substituted Trustee.
