WHEREAS, on or about July 14, 2022, Jackie G. Betts AKA Jackie Glenn Betts and Shelby C. Betts, a married couple, executed a Deed of Trust to Tim Williams, Trustee for the benefit of 21st Mortgage Corporation, as recorded in the office of the Chancery Clerk of Webster County, Mississippi, in Book 2022 at Page 391, reference to which is hereby made; and,
WHEREAS, said 21st Mortgage Corporation, under the power granted to it in said Deed of Trust, by instrument dated November 2, 2023, duly spread upon the record and recorded in Book 2023 at Page 580, in the office of the Chancery Clerk aforesaid, did substitute the undersigned Marc K. McKay in the place and stead of the original Trustee and of any other Substituted Trustee; and,
WHEREAS, default having been made in the terms and conditions of said Deed of Trust, and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said Deed of Trust, and the legal holder of said indebtedness having requested the undersigned Substituted Trustee to execute the Trust and sell said land and property in accordance with the terms of said Deed of Trust, for the purpose of raising the sums due thereunder, together with attorney’s fees, Substituted Trustee’s fees and expenses of sale;
NOW, THEREFORE, I, the undersigned Marc K. McKay being the Substituted Trustee, do hereby give notice that on January 17, 2024, between 11:00 o'clock a.m. and 4:00 o'clock p.m., being the legal hours of sale, I will proceed to sell at public outcry, to the highest bidder for cash, at the Main Front Door of the Webster County Courthouse located at 6333 Mississippi Highway 9, in Walthall, State of Mississippi, the following real property described and conveyed in said Deed of Trust, lying and being situated in Webster County, Mississippi, and being more particularly described as follows, to-wit:
All that part of the S 1/2 of the NE 1/4 of the NW 1/4 of Section 29, Twp. 21 North, Range 11 East that lies West of Fire Tower Road being 7 acres, more or less.
Less and except therefrom: 1.85 acres, more or less, described as commencing at a 3/8 inch iron pin found on the SW corner of the NE 1/4 of the NW 1/4 of Section 29, Township 21 North, Range 11 East, Webster County, Mississippi; run North 00 degrees 20 minutes 52 seconds West a distance of 241.55 feet to a 1/2 inch iron pin set on an existing old fence line and the Point of Beginning of the parcel herein described. From said Point of Beginning, run along said fence line North 00 degrees 20 minutes 52 seconds West a distance of 427.85 feet to a 1/2 inch iron pin set on the South right-of-way of Fire Tower Road; thence along said right-of-way as follows, with a curve turning to the left with an arc length of 268.40 feet, with a radius of 1432.48 feet, with a chord bearing of South 48 degrees 16 minutes 20 seconds East, with a chord length of 268.00 feet; thence South 53 degrees 49 minutes 53 seconds East a distance of 121.48 feet to a 1/2 inch iron pin set; thence leaving said right-of-way run South 31 degrees 22 minutes 23 seconds West a distance of 250.88 feet to a 1/2 inch iron pin set; thence North 77 degrees 32 minutes 22 seconds West a distance of 168.86 feet back to the Point of Beginning. Said parcel is located in the NE 1/4 of the NW 1/4 of Section 29, Township 21 North, Range 11 East, Webster County, Mississippi.

MS MUNICIPALITY AND COUNTY WATER INFRASTRUCTURE GRANT (MCWI) PROGRAM
REQUEST FOR PROPOSALS FOR ENGINEERING SERVICES
The Town of Mathiston, (OWNER) requests proposals from qualified firms or individuals to provide engineering services on an as needed basis for a project funded by the Mississippi Department of Environmental Quality American Rescue Plan Act: Mississippi Municipality and County Water Infrastructure Grant Program and/or other state and federal funds.
You are invited to submit five (5) copies of a proposal, in accordance with this request, by mail or hand-delivered to : Town of Mathiston, Post Office Box 178, 41 Mathis Drive, Mathiston, Mississippi 39752 (phone: 662-263-4898) no later than 2:00 p.m., February 5, 2024.
Selection of an engineer will be based on the criteria established in this Legal Advertisement. Engineer(s) shall not submit any cost or price information with their proposals. Engineer(s) should submit complete proposals sufficient for final selection of the most qualified engineer. The selected Engineer will provide all engineering services through project closeout in accordance with federal, state, and local laws, regulations and policies. The scope of work may include, but is not limited to the following: 1) planning services and/or guidance in selecting a project based on system needs; 2) preparation of plans and specifications; 3) distribution of bid documents and any addenda to such documents; 4) assistance in bid opening and preparation of bid tabulation; 5) assistance in the execution of construction contracts; 6) holding pre-construction conference; 7) providing construction management services, including review/approval of payment applications, preparation of change orders, attendance at regular meetings with construction contractor, and performance of construction observation including periodic reports to the OWNER, and 8) assistance with project closeout. The final scope of work will be negotiated at the time of contract execution.

All proposals must be submitted in a sealed envelope and marked with the following language: “Proposal for Engineering Services for MDEQ MCWI Project.” Proposals will be evaluated on the following factors: Qualifications (40 points), Experience (40 points), and Project Knowledge (20 points). To be evaluated properly, the following must be addressed in detail:
Qualifications – The qualifications of the firm and persons assigned to the project;
Experience – The firm’s experience and the projects previously undertaken, the project activities and the status of the projects.
Project Knowledge – Familiarity with the Owner’s infrastructure and regulatory requirement of similar funding programs.
The OWNER will designate a selection committee to evaluate each proposal. The selection committee may hold proposals for a period not to exceed thirty (30) days for the purpose of reviewing the content of the proposals and investigating the qualifications of the firms and assigned individuals. The OWNER reserves the right to reject any and/or all proposals. The OWNER will award a contract with the qualified individual or firm whose proposal has the highest number of cumulative points issued by the selection committee and determined to be the most advantageous to the OWNER, all factors considered. The contract will include the scope and extent of work and other essential requirements. The contract will be on a fixed price basis. The OWNER has the authority to terminate the selection at any time.
