SUBSTITUTE TRUSTEE’S NOTICE OF SALE
WHEREAS, on June 6, 2000, Denese Barksdale and John Barksdale executed a deed of trust for the benefit of Centex Home Equity Corporation, which deed of trust was recorded on June 13, 2000, in Book 141, Page 789 in the office of the Chancery Clerk of Choctaw County, Mississippi; and Said Deed of Trust was last sold, assigned and transferred to THE BANK OF NEW YORK MELLON F/K/A THE BANK OF NEW YORK as successor in interest to JP Morgan Chase Bank, N.A. as Trustee for Soundview Home Loan Trust 2005-CTX1 Asset-Backed Certificates, Series 2005-CTX1 by assignment recorded Book 2023, Page 820 in the office of the Chancery Clerk, Choctaw County, Mississippi.
WHEREAS, the holder of the deed of trust at the time of the substitution substituted McCalla Raymer Leibert Pierce, LLC as Trustee, as authorized by the terms thereof, by instrument recorded on October 17, 2023, and spread at large upon the records in the office of the aforesaid Chancery Clerk in Book 2023, Page 1337, prior to the posting and publication of this notice; and
WHEREAS, default having been made in the terms and conditions of the deed of trust, and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of the deed of trust, and the legal holder of said indebtedness, THE BANK OF NEW YORK MELLON F/K/A THE BANK OF NEW YORK as successor in interest to JP Morgan Chase Bank, N.A. as Trustee for Soundview Home Loan Trust 2005-CTX1 Asset-Backed Certificates, Series 2005-CTX1
has requested the undersigned Substitute Trustee to execute the trust and sell said land, property and improvements in accordance with the terms of the deed of trust for the purpose of raising the sums due thereunder, together with attorney's fees, Substitute Trustee’s fees and expenses of sale;
THEREFORE, on December 1, 2023, the undersigned Substitute Trustee in the deed of trust, will offer for sale at public outcry and sell to the highest bidder for cash, within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.) at the North front door of the Choctaw County Courthouse in Ackerman, Mississippi, the following described land, property and improvements lying and being situate in Choctaw County, Mississippi, to-wit:
The following parcel of land located in the County of Choctaw, State of Mississippi, the more particular description of which is as follows: Commencing at the Southwest corner of the Southeast Quarter (SE1/4) of the Southeast Quarter (SE1/4) of Section 24, Township 17 North, Range 10 East, Choctaw County, Mississippi, run thence East 746 feet to the Southwest corner of this parcel of land and the point of beginning of this description; thence run East for 310 feet; thence run North 3 degrees 00 minutes East for 539 feet to a point on the South ROW line of the South Union public road; thence North 79 degrees 20 minutes West for 392 feet along said ROW; thence South 4 degrees 25 minutes East for 614.7 feet to the point of beginning, all being a part of the SE1/4 SE1/4 of Section 24, Township 17 North, Range 10 East, Choctaw County, Mississippi, together with all buildings and improvements situated thereon.
I WILL CONVEY only such title as is vested in the Substitute Trustee.
