Whereas, on February 4, 2022, Dylan Mann and Britnie Mann, executed a Deed of Trust to Kasey Young as Trustee for the use and benefit of Jennifer Sims, beneficiary, which said Deed of Trust is of record in Deed of Trust Book 231 at Page 188 in the office of the Chancery Clerk in and for Choctaw County, Mississippi, and
WHEREAS, by instrument dated July 31, 2023, Kevin Null was substituted in the place and stead of Kasey Young as Trustee by instrument executed by Jennifer Sims, said instrument being recorded in Land Deed Book 2023 at page 652, and
WHEREAS, default has been made in the payment of such sums secured by said Deed of Trust and the said Jennifer Sims, being the holders of such indebtedness and the Deed of Trust, has made demand on said debtor for the payment of such sums secured by said Deed of Trust, and default has been made in the payment of such sums secured by said Deed of Trust whereupon the undersigned Substituted Trustee has been requested and ordered by said Jennifer Sims, to proceed in the manner provided therein and to foreclose the said Deed of Trust.
NOW THEREFORE, I, Kevin Null, Substituted Trustee in the aforesaid Deed of Trust, by virtue of the authority vested in me by said Deed of Trust and the aforesaid written instrument appointing me as Substitute Trustee, will offer for sale, and sale at public auction, for cash, within legal hours (being between the hours of 11:00 o'clock a. m. and 4:00 o'clock p. m.) on the 16th day of October, 2023, at the North door of the Choctaw County Courthouse, in the Town of Ackerman, Choctaw County, Mississippi, that certain property situated in Choctaw County, State of Mississippi, being more particularly described as follows:
COMMENCING at a 3/4" IP found at the NW corner of the SW 1/4 of the NW 1/4 of Section 32, T-17-N, R-11-E, Choctaw County, Mississippi run South a distance of 43.03' to a 1/2" rebar found which marks the POINT OF BEGINNING of this lot or parcel of land herein described and conveyed. From said POINT OF BEGINNING run East a distance of 318.75' to a 1/2" rebar found on the Westerly ROW of Mississippi Highway 15; thence run along the Westerly ROW of said highway as follows: S 16°21'23" E a distance of 207.89'; thence S 16°49'28" E a distance of 193.87' to a 1/2" rebar found on the Northerly ROW of McGee-Thompson Road; thence run along the Northerly ROW of said road S 50°00'43" W a distance of 381.26' to a 1/2" rebar found; thence run N 36°47'12" W a distance of 235.95' to a 1/2" rebar found; thence run North a distance of 441.09' to the POINT OF BEGINNING. This lot or parcel of land is located in the SW 1/4 of the NW 1/4 of Section 32, T-17-N, R-11-E, Choctaw County, Mississippi and contains a total of 4.63 acres.
I, the undersigned Substituted Trustee, will convey only such title as is vested in me as Substituted Trustee, and such title as I am authorized to convey by virtue of the above described Deed of Trust and the appointment of Trustee.

Sealed bids or electronic bids will be received by the Town of Weir until 2:00 pm on October 31, 2023. Sealed bids will be received until the designated date and time at the Office of the Mayor in the Town Hall, 360 Front Street, Weir, Mississippi. All bids will be thereafter publicly opened for the Sanitary Sewer Collection System Improvements, CDBG Public Facilities Project #1138-21-383-PF-01, CES Project #22-1378, in Weir, Choctaw County, Mississippi.
The Work consists of rehabilitation of approximately 3,350 linear feet of 8” diameter gravity piping with CIPP Sewer Pipe and associated work.
Detailed plans and specifications for the above described work are on file at the Weir Town Hall, 360 Front Street, Weir, MS 39772. Plans and Proposals may be obtained from the Project Engineer, Crowder Engineering & Surveying, Inc., P.O. Box 1209, 1150 West Main Street, Ackerman, Mississippi 39735, 662-285-2062, upon payment of $100 for each set, non-refundable. Plans and Proposals may also be downloaded electronically for a non-refundable fee of $25.00 by providing QuestCDN Project Number 8738063 on the Project Search Page on the Quest website www.questcdn.com.

Contract Time for the project is forty-five (45) Working Days with a liquidated damages provision of two hundred dollars ($200.00) per calendar day thereafter.
The Award, if made, will be made to the lowest and best qualified bidder on the basis of the published quantities.
The attention of the Bidder is directed to the fact that this project is being assisted by the United States of America and is subject to Federal Labor Standard Provisions. MINIMUM WAGE RATES for this project have been predetermined by the Secretary of the Department of Labor in accordance with the requirements of Federal regulations governing the expenditure of HUD funds and are set out in the labor regulations contained in the proposal.
Minority and Women’s business enterprises are solicited to bid on this contract as prime contractors and are encouraged to make inquiries regarding potential subcontracting opportunities and equipment, material, and/or supply needs.
A certified check or Bid Bond equal to five percent (5%) of the total Bid, made payable to the
Town of Weir, must accompany each Bid proposal.
All Bidders responding to this Advertisement for Bids must comply with all applicable requirements of Chapters 3 and 5 of Title 31 of the Mississippi Code of 1972, as amended, including, but not limited to, the requirements relative to holding a Certificate of Responsibility and payment of a special privilege tax; both items administered by the Mississippi State Board of Public Contractors.
All Bids received shall display the Bidder’s Certificate of Responsibility Number on the outside of the sealed envelope containing his proposal or on the electronic envelope accompanying an electronic bid submittal.
The Successful Bidder must provide both a Performance Bond and a Payment Bond (each in the amount of one hundred percent [100%] of the Contract) upon execution of the Contract.
No Bidder may withdraw his Bid within Sixty (60) days after the actual date of the opening thereof. Within the limitation of the state law, the Town of Weir reserves the right to reject any or all bids received, to waive any informalities or irregularities in the bids received, or to accept any bid that is deemed most favorable to the Town of Weir.
This project is funded through a grant from the Mississippi Community Development Block Grant Program and is a Section 3 covered activity as defined by the Housing and Urban Development Act of 1968 (12 U.S.C. 1701u) (section 3). Contractors and subcontractors are encouraged to provide, to the greatest extent feasible, training, employment, and contracting, opportunities generated by the expenditure of this assistance to low-and very low-income persons and business concerns owned by low-and very low-income persons, or which employ low-and very low-income persons. Preference can be given to businesses that comply with Section 3. All Minority Business Enterprises (MBE) and Women Business Enterprises (WBE) are encouraged to participate in the bid process.

Sanders, and Kristopher Darn Reynolds and Destiny Gabrielle Boykin, minors, seeking to terminate your parental rights as those rights relate to said minors and demanding that the full custody, control, and authority to act on behalf of said minors be placed with the Choctaw County Department of Child Protection Services.
