NOTICE OF SUBSTITUTE TRUSTEE’S SALE

WHEREAS, default has occurred in the performance of the covenants, terms and conditions of a Deed of Trust dated August 22, 2018, executed by ERIC G. JOHNSTON, II and EMILY R. JOHNSTON conveying certain real property therein described to CYNTHIA PORTERFIELD, as Trustee, for Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for Fairway Independent Mortgage Corporation, Original Beneficiary, to secure the indebtedness therein described, as same appears of record in the office of the Chancery Clerk of Choctaw County, Mississippi filed and recorded August 24, 2018, in Deed Book 217, Page 684; and
WHEREAS, the beneficial interest of said Deed of Trust was transferred and assigned to FLAGSTAR BANK, N.A.; and
WHEREAS, Rubin Lublin, LLC has been appointed as Substitute Trustee; and
NOW, THEREFORE, the holder of said Deed of Trust, having requested the undersigned so to do, as Substitute Trustee or his duly appointed agent, by virtue of the power, duty and authority vested and imposed upon said Substitute Trustee shall, on March 8, 2024 within the lawful hours of sale between 11:00AM and 4:00PM at the north front door of the Courthouse proceed to sell at public outcry to the highest and best bidder for cash or certified funds ONLY, the following described property situated in Choctaw County, Mississippi, to wit:

THENCE N 00 15`07"E, ALONG THE WEST LINE OF SAID SECTION 30, TOWNSHIP 17 NORTH, RANGE 9 EAST, FOR A DISTANCE OF 200.06 FEET TO A 1/2" IRON PIN SET ON THE REMNANTS OF ON OLD FENCE; THENCE S 85 22`39"E, ALONG SAID REMNANTS OF ON OLD FENCE, FOR A DISTANCE OF 208.56 FEET TO A 1/2" IRON PIN SET IN THE CENTERLINE OF OLD HIGHWAY NO. 413; THENCE S 20 32`32"W, ALONG SAID CENTERLINE OF OLD HIGHWAY NO. 413, FOR A DISTANCE OF 160.37 FEET TO A 1/2" IRON PIN SET; THENCE N 78 12`04"E FOR A DISTANCE OF 123.62 FEET TO A 1/2" IRON PIN SET ON THE WEST RIGHT-OF-WAY LINE OF NEW MISSISSIPPI STATE HIGHWAY NO. 413, SAID POINT BEING ON A 5.350278 CURVE BEARING TO THE RIGHT; THENCE RUN SOUTHWESTERLY, ALONG SAID WEST RIGHT-OF-WAY LINE OF NEW MISSISSIPPI STATE HIGHWAY NO. 413 AND THE ARC OF SAID CURVE, FOR AN ARC LENGTH OF 304.94 FEET (CHORD=S 21 40`13"W 303.91`); THENCE WEST FOR A DISTANCE OF 162.26 FEET TO A 1/2" IRON PIN SET ON THE WEST LINE OF SAID SECTION 31, TOWNSHIP 17 NORTH, RANGE 9 EAST; THENCE N 00 15`07"E, ALONG SAID WEST LINE OF SECTION 31, TOWNSHIP 17 NORTH, RANGE 9 EAST, FOR A DISTANCE OF 224.08 FEET TO THE POINT OF BEGINNING, CONTAINING 2.000 ACRES, MORE OR LESS.
PROPERTY ADDRESS: The street address of the property is believed to be 5180 MS HIGHWAY 413, FRENCH CAMP, MS 39745. In the event of any discrepancy between this street address and the legal description of the property, the legal description shall control.
Title to the above described property is believed to be good, but I will convey only such title as is vested in me as Substitute Trustee.
