SUBSTITUTED TRUSTEE’S NOTICE OF SALE
WHEREAS, on April 28, 2006, Joseph Watson & Pam Watson, husband and wife, executed a deed of trust to Roger D. Murphree, Trustee for the benefit of Mortgage Electronic Registration Systems, Inc., as Beneficiary, acting solely as Nominee for New South Federal Savings Bank, which deed of trust is recorded in Deed of Trust Book 171 at Page 773 in the Office of the Chancery Clerk of the County of Choctaw, State of Mississippi; and
WHEREAS, the aforesaid deed of trust was assigned to Beal Bank by instrument dated June 11, 2010, and recorded in the Office of the aforesaid Chancery Clerk in Book 189 at Page 10; and
WHEREAS, the aforesaid deed of trust was assigned to Property Acceptance Corp. by instrument dated June 11, 2010, and recorded in the Office of the aforesaid Chancery Clerk in Book 189 at Page 13; and
WHEREAS, the aforesaid deed of trust was assigned to LPP Mortgage Ltd. by instrument dated August 10, 2010, and recorded in the Office of the aforesaid Chancery Clerk in Book 189 at Page 16; and
WHEREAS, by name change effective August 23, 2017, LPP Mortgage Ltd. became LPP Mortgage, Inc.; and
WHEREAS, the aforesaid, LPP Mortgage, Inc., the holder of said deed of trust and the note secured thereby, substituted Underwood Law Firm PLLC, as Trustee therein, as authorized by the terms thereof, by instrument dated February 28, 2020 and recorded in the Office of the aforesaid Chancery Clerk in Book 227 at Page 237; and
WHEREAS, default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby, having been declared to be due and payable in accordance with the terms of said deed of trust, and the legal holder of said indebtedness, LPP Mortgage, Inc., having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust for the purpose of raising the sums due thereunder, together with attorney’s fees, Substituted Trustee’s fees and expense of sale;
NOW, THEREFORE, WE, Underwood Law Firm PLLC, Substituted Trustee in said deed of trust, will on the 4th day of August, 2021, offer for sale at public outcry for cash to the highest bidder, within legal hours (being between the hours of 11:00 A.M. and 4:00 P.M.) at the Main front door of the County Courthouse at Ackerman, County of Choctaw, State of Mississippi, the following described property situated in the County of Choctaw, State of Mississippi, to-wit:
Beginning at the Northeast Corner of that certain parcel of land conveyed to Floyd Lee by J.R. Williams by his Warranty Deed recorded in Choctaw County Land Deed Book 16, Page 367; go thence West for a distance of 190 feet and there corner; thence go South for a distance of 95 feet, and there corner; thence go East for a distance of 190 feet to the Western right-of-way boundary of College Street, and there corner; thence return North along the said Western right-of-way boundary of said College Street for a distance of 95 feet to the Northeast Corner and Point of Beginning of the description of the parcel of land herein conveyed; which said parcel of land is located in the Town of Ackerman, County of Choctaw, State of Mississippi, together with all buildings and improvements situated thereon.
The above described property shall be sold on an "As Is, Where Is" basis without warranty or recourse, express or implied, as to title, possession, use and/or enjoyment and further subject to the following: Any unpaid taxes against the property, any prior or superior easements, conditions, covenants, rights-of-way or subdivision plats affecting the property, any dedication of roads affecting the property and any governmental zoning and subdivision ordinances or regulations in effect and any prior or superior liens.
WE WILL CONVEY only such title as is vested in Underwood Law Firm PLLC as Substituted Trustee.
